Terms and Conditions of the Giveaway (the ‘Giveaway’)

This Giveaway will run in total from Wednesday 4 December until 10 December 2024, 23.59 CET by Padel Addict.

Unless otherwise stated, this Giveaway is free of charge and subject only to these Terms and Conditions and all applicable laws and regulations.

By entering and participating in this Giveaway, you (‘Entrant’, or ‘You’) agree to be bound by these Terms and Conditions and represent that you meet all of the entry requirements set forth below. If entrants do not agree to these Terms and Conditions, they will not be eligible to participate in the Giveaway.

CLAUSE 1.- ORGANISATION

Padel Addict organises on the dates indicated below a free giveaway in accordance with the modalities described in these terms and conditions.

Carchia does not act in any case as operator of this giveaway.

CLAUSE 2.- ELIGIBILITY

1.1 You acknowledge that you are at least 18 years of age (or the age of majority in your jurisdiction, if older) at the time of entering and that you have read and accepted these Terms and Conditions.

1.2 Please note that Padel Addict will not be liable in the event that Entrants are not legally permitted to enter the Giveaway due to national or local laws.

1.3 The giveaway is valid for Europe.

CLAUSE 3.- GIVEAWAY PERIOD

This Giveaway begins on 4 December 2024 and ends on 10 December 2024, 23.59 CET (‘Giveaway Period’). Entries received after this date will not count towards the giveaway.

CLAUSE 4.- GIVEAWAY AND PARTICIPATION RULES

4.1 Participation in this Giveaway is only possible via Instagram (‘Platform’). To participate in this Giveaway, it is necessary to have an account on the Platform. Entrants may only enter the Giveaway from a single profile on the Platform. This Giveaway is not linked to the Platform and is not sponsored, endorsed, administered by, or otherwise associated with the Platform. Your use of the Platform is subject to the Platform Terms of Use, for further details please see here. Padel Addict disclaims all liability in the event that the User breaches the Platform Terms of Use.

Please also make sure that Your account on the Platform is publicly accessible so that you can be contacted in case you are drawn as a winner. Only if you follow all the steps of the described procedure will you be able to participate in the Giveaway.

4.3 Padel Addict is not responsible for the actions of the Participant in the process of the giveaway. Especially if other accounts are mentioned (tagged), Padel Addict assumes no liability for the compliance of third parties or any Participant. Comments or opinions whose content is deemed inappropriate, offensive, insulting or discriminatory, or which may violate the rights of third parties, will not be permitted. If it becomes apparent that any of the Participants has not complied with the requirements of these Rules, or that the data provided for participation are not valid, the participation will be considered void and the Participant will be automatically excluded from the Giveaway, losing any right to the prize or prizes offered in the Giveaway. Padel Addict reserves the right to determine alternative winners by carrying out subsequent random giveaways until the required number of winners is determined.

CLAUSE 5.- SELECTION PROCESS

5.1 Entries for the giveaway will close on 10 December 2024, 23.59 CET and winners will be selected at random from all correct entries made by that time.

5.2 The winners of this Giveaway will be informed on the Platform by direct messaging within 3 days. Any information necessary for Padel Addict to carry out this Giveaway (e.g. the winner’s delivery address) will also be provided via direct messaging on the Platform.

5.3 If you are a winner, please wait to receive our message and reply by sending us your full name, email address, telephone number and the delivery address to which you would like us to send the prize. The contact details you provide will be used to notify you and deliver the prize to you, so please ensure that they are correct.

5. 4 Padel Addict undertakes to use reasonable efforts to maintain an adequate hardware and software service for the Giveaway and will not be liable for: late, lost, delayed, damaged, misdirected, incomplete, illegible or unintelligible entries; telephone, electronic, hardware or software, network, internet or computer malfunctions, failures, delays or difficulties; errors in transmission; prize notifications attempted but not received; any loss suffered by any person entering or attempting to enter the Giveaway, whether or not the entry is lost, not submitted, mis-processed or not a winner.

CLAUSE 6.- THE PRIZE

6.1 There will be a single winner who will win a Babolat Viper Juan Lebrón 2025.

The prize will be sent by post to the delivery address we receive from the winner of the Giveaway. The shipping costs of the prize will be borne by Carchia.

6.2 Carchia reserves the right to substitute the prize for another prize of similar value.

6.3 The winner may refuse any prize awarded.

6.4 No cash alternatives will be offered and the prize is non-exchangeable, non-transferable and non-refundable.

6.5 In the event that the winner does not claim their prize within 7 days of notification, they will have forfeited the prize and Padel Addict reserves the right to determine an alternative winner based on a second random selection.

6.6 The Giveaway will be conducted at the sole discretion of Padel Addict. Padel Addict’s decision in relation to all matters relating to the Giveaway is final and no correspondence will be entered into.

6.7. Recourse to the courts is excluded.

CLAUSE 7.- COLLECTION OF INFORMATION AND DATA PROTECTION

7.1 General: For further information and details on data processing, please see our Privacy Policy. Padel Addict (‘Data Controller’) hereby gives notice that all personal data referred to in paragraphs 3 and 4 of these Terms and Conditions will be processed by Padel Addict for the purpose of organising and carrying out the Giveaway (e.g. to contact the winner).

7.2 Duration of storage: Personal data will be processed solely for the purpose of conducting the Giveaway and thus for the purpose of contractual performance. Padel Addict will delete the winners’ personal data after 7 years from the end of the calendar year in which the prize was received or, where applicable, until the expiry of the statutory warranty, limitation and retention periods valid for Padel Addict and/or beyond this until the end of any legal litigation in which the data is required as evidence.

7.3 Individual rights: Participants have the right to information about their stored personal data, to the deletion and rectification of stored data concerning them, to withdraw their consent to the processing of their personal data, if such consent has been given, and to data portability. Participants also have the right to object to the processing of their personal data. To exercise any of these rights, Participants may send a request to info@padeladdict.com indicating to which right they refer. In addition, Participants have the right to lodge a complaint with the competent supervisory authority.

7.4 Obligations of the Participant: The Participant hereby expressly warrants that personal data (including images of third parties) will only be transferred to Padel Addict in accordance with applicable national and European data protection legislation. The Participant warrants that, before disclosing personal data of any other third party, he/she will ensure that such third party has received all data protection information contained in these Terms and Conditions.

CLAUSE 8.- PLACE OF JURISDICTION AND APPLICABLE LAW

8.1 These General Terms and Conditions are subject exclusively to Spanish law, provided that it does not contravene any mandatory legislation.

8.2 Any legal issues arising in connection with the execution of and participation in this giveaway shall be dealt with exclusively by the relevant courts at the place of jurisdiction of Padel Addict’s headquarters, provided that this does not contravene any mandatory legislation. However, Padel Addict may also choose to refer the matter to the courts of the Participant’s place of residence.

8.3 Should any of the clauses of these General Terms and Conditions be wholly or partially invalid, the validity of the remaining clauses shall not be affected.
